Terms & Conditions
Definitions:
In these Terms and Conditions;
“Care Refunds”, “we”, “our” or “us” means the registered refund consulting business trading as Care Refunds ABN: 68470504901.
“You”, “your”, “their”, “client” or “claimant” means the person, organization or entity that engages the services provided by Care Refunds.
“Recovered Funds” means all money directly recovered or identified for recovery by Care Refunds on the client’s behalf.
“Care Refunds services” means our services in locating unclaimed money belonging to the client and arranging their return.
Authority to Act
Care refunds cannot disclose the source of your funds prior to receiving your signed “Authority to Release” form.
By signing the “Authority to Release” form you hereby engage Care Refunds to act on your behalf and authorise us to do anything reasonably necessary so that we may fulfil our obligations and provide the Services to you and this shall include, but is not limited to, authority to engage with and contact third party organisations on your behalf.
Once the “Authority to Release” is signed the claimant shall not withdraw from our services to process the claim without payment of the agreed fee.
Delivery of Services
We shall make reasonable efforts to ensure that the recovered funds owing to you are returned to you within nine (9) weeks from receipt of ALL correct documentation and information requested from you to process the claim. Care Refunds and its employees are not responsible for any delays in processing of claim and accept no responsibility for any claim, loss, or liability arising from any such delays.
Care refunds will provide updates to the client during the claim process either by phone call or SMS, Email or by Post as per the client’s preferred communication method.
The client accepts that they are responsible for providing correct information and documents within requested timeframes and that incorrect information or delays in providing such information may cause delays in receiving their unclaimed money.
Client Obligations
The client shall supply all necessary identification information (including provision of certified hard copies of such identification documents) for us to complete and lodge the claim with the relevant authority. Documents required for proof of identity depend on the source organization and/or authority withholding the unclaimed money.
The client shall supply all other details such as tax file number depending on the nature or complexity of the claim and the withholding authority’s requirements.
The client shall complete all necessary claim and authority forms and any additional forms needed to finalise the claim, recover your unclaimed funds or pay such recovered funds to your bank account and arrange for such forms to be witnessed and/or certified as required.
Pursuant to signing the “Authority to Release” form, the client shall not directly or indirectly contact third party organisations identified by Care Refunds as potentially holding their lost or unclaimed funds for the purposes of making a claim for such lost or unclaimed funds. The client acknowledges that failure to comply means payment of our Services shall still be owing to us in this instance as per these Terms.
Payment of Fees
All payments shall be made in Australian dollars.
Care Refunds fee including GST where applicable is payable for all monies recovered, upon recovery of funds. Care Refunds will invoice the service fee in accordance with the agreed fee value with the client. This agreed amount is payable to Care Refunds upon recovery of funds and within seven (7) days on receipt of invoice.
The client acknowledges that where the recovered funds are to be deposited electronically by Care Refunds, they will receive the total value of the recovered funds less Care Refunds agreed service fee. The client accepts they are responsible for providing the correct details and that incorrect information may cause delays in receiving their recovered funds.
No payment is required from the client if we are not successful in recovering your unclaimed funds, except in the below instances where Care Refunds will give seven (7) days notice to the client, the client’s file will be closed and payment of agreed fee will be required;
Where we are not successful in recovery due to termination of these Terms due to client pursuing the relevant third parties for recovery without the use of our Services once the “Atuthority to Release” has been signed.
Where the claimant withdraws from supplying relevant documents requested (within the client’s ability) to complete the claim.
Where the client elects to terminate the agreement for whatever reason with Care Refunds to complete the claim.
Where we are not successful in recovery due to termination of these Terms due to client pursuing the relevant third parties for recovery without the use of our Services once the “Atuthority to Release” has been signed.
Where the claimant withdraws from supplying relevant documents requested (within the client’s ability) to complete the claim.
Where the client elects to terminate the agreement for whatever reason with Care Refunds to complete the claim.
Should suit be commenced or an attorney employed to enforce payment of the recovery fee pursuant to these Terms, the claimant agrees to pay such additional sum as the court may adjudge reasonable as attorney’s fees in the said suit.
Limitation of Liability
Care Refunds accepts no responsibility for the accuracy, currency or completeness of any information provided via any correspondence and or communications. The accuracy or reliability of information provided is not guaranteed or warranted in any way and Care Refunds, its agencies, representatives, subsidiaries and affiliates disclaim liability of any kind whatsoever, including & without limitation, liability for accuracy, quality, performance, or reliability for a particular purpose arising out of the information provided.
Care Refunds accepts no liability for your failure or inability or delay in supplying the information or forms or other documentation (in particular for the purposes of identification) required to complete a claim for unclaimed funds.
Care Refunds accepts no liability or responsibility for the failure of third party organisations (including government departments) to respond satisfactorily or at all to any claims made to such organisations or departments on your behalf. The client will be provided with regular updates during the claim process.
Care Refunds will not be liable for any delay or failure to perform their obligations under the Terms if such delay is due to any circumstance beyond the reasonable control of Care Refunds. If we are delayed from performing our obligations due to such a circumstance for a period of at least 2 months, we may terminate our agreement with you by giving you 5 business days’ notice in writing.
General
These Terms & Conditions can be varied at any time by Care Refunds upon provision of seven (7) days notice in writing to the client detailing such changes.
Acceptance of our service is automatic acceptance of all Care Refunds Terms & Conditions.
Privacy Policy
Your privacy is important to Care Refunds. We know that keeping client information secure is a top priority. The information you provide is only used to secure the recovery of your money.
All Investigators employed by Care Refunds are committed to providing you with quality recovery services within a secure and private environment.
This privacy statement provides information about the personal information that Care Refunds collects, and the ways in which Care Refunds uses that personal information.
Personal information collection
Your personal or company information which can identify you including your name, email address and contact details or any other information in order for us to make contact with you in order to have the required information to recover of your unclaimed funds.
Using personal information
Care Refunds may use your personal information to contact you by email or phone to search for unrecovered funds that are owing to you and assist you in the recovery of your lost or unrecovered funds.
Retention of data
We only retain your company or personal data for as long as necessary for us to render a service to you for the recovery of your funds, except where otherwise provided by law.
Securing your data
Care Refunds do take considerable technical and organizational precautions to prevent the loss, or misuse of your company or personal information.
